These Terms of Use (the "Terms") are an agreement between you and Kimbytes ("we", "us") for the app Chess Clock, Scoreboard & Dice (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
These Terms are between you and Kimbytes only, not Apple Inc. ("Apple"). Kimbytes, not Apple, is solely responsible for the App and its content. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent, sublicense or reverse engineer the App, remove any notices, or use the App for any unlawful purpose. We keep all rights not expressly granted to you.
The App provides a chess clock, a scoreboard, a dice roller, tally counters and a random number generator. Gameplay tools work offline. The clock keeps time using your device's clock and is intended for casual and club play; for rated or official events, follow your organiser's rules on approved clocks. The App does not read a physical board or detect checkmate. Players confirm results themselves, and you are responsible for checking the display.
The chess clock, including every preset and timing mode, is free. The free scoreboard supports up to 4 players, the free counters up to 3, and free dice are six-sided. Pro unlocks up to 12 players, up to 12 counters, the d4 to d100 dice set, custom time controls and named saved games. Pro is offered as an auto-renewable Monthly subscription or as a one-time Lifetime purchase, bought through Apple. Prices are shown in the App before you buy.
Payment is charged to your Apple Account when you confirm the purchase, or when an eligible free trial ends. The Monthly subscription renews automatically unless you cancel at least 24 hours before the current period ends; renewal is charged within 24 hours before the period ends. Free trials, where offered, are available to eligible users on the Monthly plan and convert to a paid subscription unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Manage or cancel subscriptions in Settings > your name (Apple Account) > Subscriptions on your device; deleting the App does not cancel a subscription.
Lifetime is a single payment with no renewal. It does not automatically cancel an existing Monthly subscription. Pro access is linked to the Apple Account that made the purchase; restore purchases from the App using the same Apple Account. Purchases and restoration require an internet connection so that the store and RevenueCat can verify them. Refunds are handled by Apple under Apple's policies; we cannot issue refunds for App Store purchases directly.
Player names, scores, counters, saved games and clock settings are stored on your device. Deleting the App deletes that data, and we cannot recover it. How we handle app activity and purchase data is described in our Privacy Policy.
You agree not to interfere with the App or our services, to circumvent Pro limits or purchase verification, or to use the App in a way that breaks the law or the rights of others. We may suspend or end access that abuses the App or these Terms.
Kimbytes, not Apple, is responsible for any maintenance and support of the App. Apple has no obligation to provide maintenance or support for the App. For help, contact bartiquelk@gmail.com.
To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of Kimbytes.
To the fullest extent permitted by law, Kimbytes is not liable for any indirect, incidental, special or consequential damages, or for loss of data, games, results or profits, arising from your use of or inability to use the App, including any timing inaccuracy. Our total liability for all claims relating to the App is limited to the amount you paid for the App in the twelve months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you in full.
Kimbytes, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
The App, including its design, code, sounds and text, is owned by Kimbytes and protected by copyright and other laws. If a third party claims that the App or your possession and use of it infringes that party's intellectual property rights, Kimbytes, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms when using the App, including the Apple Media Services Terms and Conditions. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
We may update the App or these Terms. When we change the Terms, the date at the top changes, and continued use of the App after that date means you accept the new Terms. We may end your licence if you breach these Terms. You may stop using the App at any time by deleting it; this does not refund past purchases or cancel a subscription.
These Terms are governed by the laws of the Republic of the Philippines, without affecting any mandatory consumer protection rights you have in the country where you live.
